Important – Please Read Carefully. By using the Domino Loyalty Program (the "Service"), you confirm that you have read, understood, and agreed to these Terms of Use. If you do not agree, you must immediately stop using the Domino mobile application (the "Application") and its services.

These Terms of Use (the "Agreement") form a legally binding contract between you and Domino Technology Sdn. Bhd. (the "Company"). By downloading, installing, or using the Application, you agree to comply with these Terms, including any future updates published at https://domino.technology/terms-of-use.

Your continued use of the Service after any updates constitutes acceptance of the revised Terms.

USER ELIGIBILITY & ACCOUNT REGISTRATION

1. REPRESENTATIONS & WARRANTIES

By using the Service, you confirm that you have the legal right, authority, and capacity to do so and to comply with these Terms.

2. ELIGIBILITY

Users under eighteen (18) years old or the legal age of consent under Malaysian law must obtain permission from a parent or legal guardian before registering. Parents or guardians assume full responsibility for the minor's actions, including any charges incurred. If you do not meet these requirements or have not obtained consent, you must discontinue use of the Service immediately.

3. REGISTRATION OF ACCOUNT

To access the full features of the Service, you may be required to create an account ("Account") by providing certain personal or business information. By registering, you agree to provide accurate, current, and complete information and to update it as needed.

Your Account may be linked to a third-party service (e.g., your mobile service provider) for streamlined registration. If any false or misleading information is provided, the Company reserves the right to suspend or terminate your Account.

If you select a User ID that is deemed inappropriate, the Company may suspend or terminate your Account. User IDs are auto-generated upon successful registration, and you may set a password and/or Sponsor PIN in accordance with security requirements.

4. USER INFORMATION

You confirm that all information provided to the Company is accurate, current, and complete. You agree to update your details as necessary to maintain their accuracy. The Company may rely on your submitted information and request proof of identity when needed. If any provided information is found to be false, inaccurate, or incomplete, the Company reserves the right to suspend or terminate your account without prior notice.

5. SINGLE ACCOUNT POLICY

Each mobile number can be associated with only one account. If you have multiple phone numbers, you may register multiple accounts, but each must be tied to a unique number. The Company reserves the right to monitor and take action against accounts suspected of fraudulent activity, misuse, or policy violations, including suspension or termination.

6. ACCOUNT ACCESS

  1. Free User Access: If you are a free user, you can access the services of the Website and App without paying any membership fees but may have limited features compared to paid members.
  2. Paid member Access: If you choose to sign up a membership, you must pay a one-time annual membership fee. This fee is non-refundable and is required to access specific features like sponsoring customers.

7. MEMBERSHIP RENEWAL POLICY

  1. Non-Renewal of Membership: If you choose not to renew your membership upon its expiry, your Premium Credits (PC) will be frozen, and you will not be able to sponsor new users or distribute Premium Credits (PC) until the membership is renewed.
  2. Using Premium Credits Before Expiry: In the event that you decide not to renew your membership, it is your responsibility to use all remaining Premium Credits (PC) before your membership expires. Domino is not liable for any unused Premium Credits (PC) if you fail to renew your membership or utilize them within the allowed period.
  3. Reactivating Account: If you choose to renew your membership at a later time, your Premium Credits (PC) will be unfrozen, and you will be able to sponsor users with Premium Credits (PC) again.

ACCOUNT SECURITY & USAGE

8. SECURITY OF ACCOUNT

To maintain the security of your Account, you agree to:

  1. Keep your password and security codes confidential.
  2. Log out after each session.
  3. Notify the Company immediately of any unauthorized use.
  4. Ensure your Account information is accurate and up to date.
  5. Use the Account in accordance with these Terms.

You are responsible for all activities conducted under your Account, even if unauthorized. The Company is not liable for any loss or damage resulting from unauthorized access.

9. AUTHORISED ACCESS

You must access the Service only through authorized means. Ensure you have downloaded the correct version of the Application for your device. The Company is not responsible for issues arising from the use of unauthorized or incompatible devices and reserves the right to deny access in such cases.

10. PERSONAL USE

The Service is strictly for personal, non-commercial use. You must not share your account credentials or allow unauthorized access. All use of the Service must comply with applicable laws and these Terms.

11. FUNCTIONALITY REQUIREMENTS

Certain features of the Application require the transmission of personal data, including but not limited to your name, email address, payment details, and membership information ("User Information"). By using these features, you consent to the collection and processing of such data by the Company and its service providers.

The Application may also request access to your mobile device's contact list for specific features, such as birthday notifications. You have the option to set your date of birth (excluding the year) as private or public.

You are responsible for maintaining the confidentiality of your User Information and for any activity conducted under your registered account, whether authorized or unauthorized.

SOFTWARE & INTELLECTUAL PROPERTY

12. SOFTWARE & APPLICATION

By using the Service, Software, and Application, you agree that:

  1. You will use them only for lawful purposes and will not engage in fraudulent, deceptive, or unauthorized activities.
  2. You will not cause harm, nuisance, or interference with their functionality, integrity, or performance.
  3. You will not copy, distribute, modify, or attempt to gain unauthorized access to any part of the Service or another user's data.
  4. You are responsible for securing your login credentials and ensuring compliance with applicable laws and third-party rights.

13. RESTRICTIONS

By using the Service, Software, and Application, you agree that:

  1. You are fully responsible for any loss or damage caused by your breach of these Terms.
  2. You will not use the Service to violate laws, infringe intellectual property, remove copyright protections, or facilitate illegal activities.
  3. You will not post, publish, or send content that is unlawful, harassing, defamatory, violent, or violates the rights of others.
  4. You will not engage in activities that harm children, promote hate, or distribute explicit or infringing material.

14. LICENSE

The Company grants you a revocable, non-exclusive, non-transferable, and limited license to use the Application, subject to these Terms. All rights not expressly granted are reserved by the Company and its licensors.

15. LICENCE CONDITIONS

You agree that you shall not:

  1. Sell, sublicense, distribute, or commercially exploit the Software or Application.
  2. Modify, create derivative works, or reverse-engineer any part of the Software.
  3. Copy, frame, mirror, or use automation tools (bots, crawlers) to interact with the Service in unauthorized ways.
  4. Operate the Application on jailbroken or rooted devices.
  5. Remove copyright, trademark, or proprietary notices from the Software or Application.

16. INTELLECTUAL PROPERTY OWNERSHIP

The Company and its affiliates own all rights, titles, and interests, including intellectual property, in the Software, Application, and Service. Any suggestions, feedback, or enhancement requests you provide become the property of the Company.

This Agreement does not transfer any ownership rights to you. The Company's trademarks, branding, and related assets may not be used without permission.

CREDITS & REWARD SYSTEM

17. PREMIUM CREDIT

For paid members, you may purchase Premium Credit in advance, which will be stored in the Application as a credit balance. Premium Credit can only be used to sponsor other users. All purchases and sponsorships must comply with this Agreement.

18. DOMINO CREDIT

Domino Credit is received when another user sponsors their Premium Credit. It can be redeemed as a discount at partner merchants. All redemptions must comply with this Agreement.

19. SAVING CREDIT

Saving Credit is sponsored by Domino Technology for every successful Premium Credit sponsorship. It may also be granted as surprise sponsorships from partner merchants. Refunds from Wantdefoo.life will be issued as Saving Credit instead of RM (Ringgit Malaysia). Saving Credit can be accumulated and used as per this Agreement.

20. REWARD POINT

Users can earn Reward Points through purchases, surveys, and campaigns. Reward Points can be converted into Saving Credit based on the platform's conversion rate, which may change based on promotions. All earnings, conversions, and redemptions are subject to this Agreement.

21. PURCHASE OF PREMIUM CREDIT

By purchasing Premium Credit, you acknowledge and agree that:

  1. Payments are processed through the platform's supported gateway, and the credited amount is based on your membership's conversion ratio.
  2. The conversion ratio varies based on membership type and is subject to change, as displayed in the My Membership section.
  3. All purchases are final, non-withdrawable, and non-refundable, except where required by law or explicitly stated in this Agreement.
  4. By completing a purchase, you authorize the platform to charge your selected payment method.
  5. The platform may impose transaction limits and suspend transactions suspected of fraud or unauthorized activity.

PAYMENTS & TRANSACTIONS

22. APPLICABLE FEES AND CHARGES

By using the Service, Software, and Application, you agree that:

  1. The amount of Domino Credit received when purchasing Premium Credit is based on a conversion ratio displayed in the My Membership section.
  2. Sponsoring Premium Credit to other users does not incur fees.
  3. Converting Reward Points into Saving Credit follows the platform's current conversion rate, subject to change.
  4. Refunds from partner merchants will be issued as Saving Credit with no processing fees.
  5. The platform may introduce charges for new features or services, with prior notification.

23. PAYMENTS

Purchases of Premium Credit must be made through the payment gateway integrated within the Application. Users can complete payments using electronic bank transfers, credit cards, debit cards, or any other available payment methods supported by the platform ("Payment Method"). The availability of payment methods may change at the Company's discretion.

24. VERIFICATION & FRAUD PREVENTION

The Company reserves the right to verify user accounts and transaction activities within the platform to maintain security and prevent fraud. Users may be required to provide additional information or complete verification steps when engaging in transactions. The Company may also conduct screenings to detect suspicious activity and ensure compliance with applicable financial regulations, including Anti-Money Laundering (AML) measures where necessary.

25. OVERSEAS CREDIT CARD

If you use an internationally issued credit card for purchasing Premium Credit, your bank or payment provider may impose additional charges, such as foreign transaction fees. The Company is not responsible for any such fees, and users should verify these charges with their payment provider before proceeding.

26. PAYMENT FAILURES & DISPUTES

If a payment fails, is disputed, or is reversed by the payment provider, the Company reserves the right to determine liability and adjust the user's credit balances accordingly. Users must resolve chargeback disputes directly with their bank.

27. TRANSACTION REJECTION & ILLEGAL USE

The Company reserves the right to reject, suspend, or reverse any transaction suspected of violating anti-money laundering (AML) or counter-terrorism financing (CTF) regulations. If unlawful activity is detected, the Company may suspend or terminate the account and report the matter to relevant authorities, as required by law.

28. REFUND POLICY

Purchases of Premium Credit are non-refundable and non-withdrawable, except where required by law or explicitly stated in this Agreement. Any refunds issued by partner merchants Wandefoo.life will be credited only in Saving Credit instead of cash. Users cannot request cash refunds for any form of credit within the platform.

29. NO INTEREST POLICY

Premium Credit, Domino Credit, and Saving Credit do not accrue interest, nor do they function as electronic money or a stored-value facility regulated under Malaysian financial laws. These credits are solely for use within the Service and are not redeemable for cash.

LIABILITY & DISCLAIMERS

30. UNAUTHORIZED TRANSACTIONS & FRAUD

If you suspect unauthorized transactions or fraudulent activity on your account, you must report it to the Company within seven (7) days from the transaction date. The Company will investigate the claim and may temporarily restrict your account during the review process. You may be required to provide supporting documents to validate your claim. The Company will notify you of its resolution within fourteen (14) business days from the date of the report. If fraud or unauthorized use is confirmed, appropriate corrective actions will be taken, which may include reversing the transaction or imposing additional security measures on your account.

31. ERROR

The Company reserves the right to correct your Credit Balance if it determines that a technical, clerical, billing, or accounting error has occurred. If you have any questions regarding your transaction history, corrections made to your Credit Balance, or if you dispute any transaction or correction, please contact our Customer Care Team at [email protected]. The Company will conduct an investigation, communicate the results, and rectify any proven error as soon as the investigation is completed.

32. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its affiliates, partners, and employees from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

  1. Your violation of these Terms of Use;
  2. Your misuse of the Application or services;
  3. Any third-party claims resulting from your actions or content shared through the platform.

33. NO WARRANTIES

The Application and its services are provided "as is" and "as available" without any warranties, express or implied. The Company makes no guarantees regarding:

  1. Uninterrupted, error-free, or secure access to the Application;
  2. Accuracy, reliability, or completeness of any information or content;
  3. Performance, availability, or merchantability of the services for a particular purpose.

To the fullest extent permitted by law, the Company disclaims all warranties and shall not be liable for any direct or indirect losses, as outlined in the "No Liability" section.

34. TELECOMMUNICATION FAILURE

The Service and Application may experience delays, interruptions, or failures due to internet connectivity, mobile network issues, or device malfunctions. The Company is not responsible for any delays, transaction failures, data loss, or damages resulting from such issues. Users are responsible for ensuring their devices are in working condition and have a stable network connection.

35. NO LIABILITY

To the fullest extent permitted by law, the Company, its affiliates, partners, and employees shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

  1. Your use of or inability to access the Application or services;
  2. Errors, delays, interruptions, or security breaches beyond the Company's control;
  3. Loss of data, unauthorized transactions, or any third-party actions affecting your account;
  4. Modifications, suspensions, or termination of any features, benefits, or partnerships.

The Company is not responsible for any technical issues or disruptions beyond its reasonable control.

GENERAL TERMS & CONDITIONS

36. NOTICES

The Company may provide notices, updates, or amendments regarding these Terms through:

  1. The Application's notification system;
  2. Email to the registered address;
  3. Official announcements on the Company's website or other designated channels.

Users are responsible for checking these communication channels regularly. Notices shall be deemed received once sent or published.

37. TAXES OBLIGATIONS

The Company does not provide tax reporting services and is not responsible for determining or reporting any tax liabilities arising from rewards, credits, or incentives earned through the Service. Users are solely responsible for understanding and fulfilling their tax obligations and should consult a qualified tax professional if necessary.

38. TRANSFERABILITY

Your account, membership, and any associated rewards under this loyalty program cannot be transferred, assigned, or sold to another person without the prior written approval of the Company. However, you may transfer Premium Credit to other users within the application as per the program's terms and conditions. The Company reserves the right to transfer or assign its rights and obligations under this Agreement without requiring your consent. Any unauthorized transfer or assignment by you shall be deemed void.

39. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by the laws of Malaysia, without regard to any conflict of law principles. Any disputes, claims, or controversies arising out of or in connection with these Terms of Use or the loyalty program shall be resolved through arbitration administered by the Asian International Arbitration Centre (AIAC) in accordance with its rules, as modified or amended from time to time. The arbitration shall be conducted in Kuala Lumpur, in the English language, by a sole arbitrator appointed by mutual agreement of the parties. If an arbitrator cannot be mutually agreed upon, the President of the AIAC shall appoint one. The arbitration fees shall be borne equally by both parties unless otherwise determined by the arbitrator to ensure enforceability under applicable law.

40. RELATIONSHIP BETWEEN PARTIES

Your participation in the loyalty program does not create any joint venture, partnership, employment, or agency relationship between you and the Company. You acknowledge that you are participating as an independent user and that no fiduciary or representative relationship exists between you and the Company or any third-party provider associated with the program.

41. SEVERABILITY

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, that provision shall be removed, and the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. This includes, without limitation, the governing law and dispute resolution provisions stated above.

42. NO WAIVER

Failure or delay by the Company in enforcing any right or provision of these Terms of Use shall not be deemed a waiver of such right or provision unless expressly agreed to in writing by the Company. Any waiver granted shall not be construed as a waiver of any future rights or provisions.

43. CHANGES

The Company reserves the right to amend, update, or modify these Terms of Use at its sole discretion, including those governing credits, rewards, promotions, and other loyalty benefits. Any changes will take effect immediately upon being posted on the Application or website.

Promotional offers, reward benefits, and points are valid only within their specified periods and are subject to their respective terms and conditions. In the event of a conflict between a promotion's terms and these Terms of Use, the promotion's terms will prevail for the duration of the promotion.

By continuing to use the loyalty program after any changes take effect, you acknowledge and accept the revised Terms.

44. COMPLAINS OR ENQUIRIES

For any complaints, questions, or assistance, users may contact the Company through:

  1. The in-app support feature;

  3. Other official contact methods as updated in the Application.

The Company will make reasonable efforts to respond within a reasonable timeframe.

45. DEACTIVATION

Users may choose to deactivate their account at any time through the My Profile section. Upon deactivation, the account will be frozen, restricting all access and transactions. However, the account can be reactivated and made usable again if the user logs in with the same credentials.

If an account remains inactive for three (3) consecutive years from the date of the last transaction (including purchases and reloads), it will be deemed dormant and automatically deactivated. Once deactivated due to inactivity, any remaining Premium Credit, Domino Credit, Saving Credit, and Reward Points will be forfeited.

Additionally, the Company reserves the right to immediately deactivate an account if it reasonably believes the user has breached or is threatening to breach these Terms of Use. In such cases, the user will lose access to the Application, and any remaining Premium Credit, Domino Credit, Saving Credit, and Reward Points will be forfeited.

46. TERMINATION

Either the Company or you may terminate this Agreement immediately with or without notification. This Agreement shall terminate immediately if you are in breach of any of the Terms of Use. The Company also reserves the right, in its sole discretion, to terminate any the licenses granted herein, the use and ability to use the Service, the deletion and removal of your content or assert legal action with respect to your content and/or your use of the Application, the Software and the Service, that the Company believes is or might be in violation of this Agreement but the Company's failure or delay in taking such actions does not constitute a waiver of its rights to enforce this Agreement.

SECTION X: TERMS OF USE FOR WDF E-COMMERCE PLATFORM

The following Terms of Use for the WDF E-Commerce Platform form an integral part of the Domino Loyalty Program Terms of Use. By accessing or using the WDF Platform within the Domino App, you agree to comply with these terms, in addition to the general terms governing the Domino Loyalty Program.

WDF E-COMMERCE PLATFORM TERMS OF USE

1. GENERAL PROVISIONS

  1. WDF is an e-commerce platform operated by Domino, offering products directly to users.
  2. By using the WDF platform, users agree to these Terms of Use, in addition to the Domino Loyalty Program Terms of Use.

2. USER ACCOUNTS

  1. Users must create an account in the Domino app to access and purchase products on WDF and utilize all available credits and benefits.
  2. Users are responsible for maintaining the security of their accounts.
  3. Any unauthorized access should be reported immediately.

3. ORDERS AND PAYMENTS

  1. Orders placed on the WDF platform are subject to availability and confirmation.
  2. Payment must be made using the methods accepted on the WDF platform. Users may use Premium Credits (PC), Saving Credits (SC), and Reward Points (RP) to receive discounts or offset part of the payment amount at checkout. However, these are not payment methods themselves, and WDF does not operate as an e-wallet.
  3. Prices are displayed in RM currency and may include applicable taxes or service fees.
  4. If a payment fails or is declined, WDF reserves the right to cancel the order. Users should report unauthorized transactions immediately.

4. SHIPPING AND DELIVERY

  1. WDF processes and ships orders within the timeframes specified at checkout.
  2. Delivery times are estimates and may vary based on location and other factors.
  3. Users are responsible for providing accurate shipping information. WDF is not liable for delays due to incorrect addresses.

5. RETURNS AND REFUNDS

  1. Order Cancellation: Users can cancel an order within 3 hours of payment by contacting customer support via the Website or App. If an order is canceled, the full amount, including delivery fees and SST on delivery fees, will be refunded in Saving Credits (SC). Any Discount Credits (DC) used for the order will be forfeited, while any Saving Credits (SC) used will be refunded. After 3 hours, the order cannot be canceled.
  2. Refunds: Items purchased on the Website or App can be refunded within 3 days after delivery. Refunds are processed in Saving Credits (SC), which can be used for future purchases. Delivery fees and SST on delivery fees are non-refundable. Any Discount Credits (DC) used will be forfeited, while only the amount paid and any Saving Credits (SC) used will be refunded in SC.
  3. Refund requests must meet the following conditions:
    1. The item must be unused, undamaged, and in its original packaging.
    2. Refund eligibility is subject to review, and Domino reserves the right to deny any refund requests that do not meet the criteria.

6. DISPUTE RESOLUTION

  1. Any disputes arising from transactions on the WDF platform should first be addressed through WDF customer support.
  2. If unresolved, disputes will be handled in accordance with applicable laws.

7. AMENDMENTS

WDF reserves the right to modify these Terms of Use at any time. Users will be notified of significant changes.

By continuing to use the WDF platform, users acknowledge and agree to these terms.
